Terms of Service

Effective Date: February 26, 2025

Welcome to Views Media. These Terms of Service (“ToS”) govern your use of our services and outline your rights and obligations when engaging with Views Media.

1. Services Provided

Views Media provides digital marketing services, including but not limited to:

  • Search Engine Optimization (SEO)
  • Google Business Profile Optimization
  • Instagram & Facebook Advertising and Account Management
  • Marketing Automation & Lead Generation
  • CRM & Lead Management System powered by GoHighLevel (GHL)
  • Analytics & Performance Tracking
  • SEO Citation Management via WhiteSpark

All services are provided as described in the Client Services Agreement.

2. Payment Terms & Currency

  • Canadian clients are billed in CAD, with taxes applied according to their province.
  • U.S. clients are billed in USD, with taxes included in the price.
  • Late payments incur a 5% late fee per month until fully paid.
  • All transactions are processed via Stripe or Intuit.
  • Chargebacks result in a 1.5% finance charge per month and reimbursement of legal fees.

3. Cancellations & Refunds

  • Clients may cancel within three (3) days of purchase for a refund minus a $250 administrative fee.
  • No refunds are provided after this period unless a Termination Event occurs.
  • Refunds exclude free or promotional service periods.

4. Client Responsibilities

Clients agree to:

  • Provide branding materials and account access.
  • Attend scheduled meetings and respond to content approvals timely.
  • Ensure compliance with local, provincial, federal, and U.S. laws.
  • Consent to the submission of their business information to third-party directories for SEO citation management.
  • Understand that search rankings and social media performance are influenced by third-party platform changes and algorithm updates beyond Views Media’s control.

5. Data Privacy & Security

Views Media follows PIPEDA (Canada) and CCPA/CPRA (California) regulations. Clients’ data may be processed by third-party providers, including:

  • Google & Facebook (Meta) – Advertising and analytics.
  • Stripe & Intuit – Payment processing.
  • GoHighLevel (GHL) – CRM and automation services.
  • WhiteSpark – SEO citation management and directory listing services.

Data transfers between Canada and the U.S. are subject to applicable privacy laws. Clients may request data access, correction, or deletion at any time.

6. Intellectual Property

  • Views Media retains ownership of its proprietary marketing strategies, templates, and systems.
  • Clients own custom branding materials explicitly created for them.
  • Clients may not reproduce, distribute, or resell Views Media’s proprietary materials.

7. Limitation of Liability

  • Views Media is not liable for third-party platform suspensions (Google, Meta, GHL, WhiteSpark).
  • Views Media’s total liability shall not exceed the fees paid in the past three months.
  • No liability is assumed for SEO ranking changes, lost profits, or third-party failures.

8. Governing Law & Dispute Resolution

  • This agreement is governed by the laws of Ontario, Canada.
  • Disputes shall be resolved first via good-faith negotiation.
  • If unresolved, disputes shall be settled via binding arbitration in Toronto, Ontario.

9. Service Termination

  • Views Media may terminate services for non-payment or contractual violations.
  • Upon termination, Clients must cease using Views Media’s proprietary materials.

10. Amendments & Notices

Views Media may update these Terms of Service periodically. Any changes will be posted on this page with an updated effective date.
